CC&R REVISIONS:

California homeowner association document revision

The Rewrite Program for homeowner association document revision

A truly unique concept in homeowner association document revision — CLARITY. The Rewrite Program™ will fully revise your association’s governing documents in a simplified, easy-to-read, clearly referenced format guaranteed to enhance their readability and usability — all for a fixed fee quoted in advance without any obligation.

The Process

The Rewrite Program™ is usually completed in three drafts. To fully assess your association’s needs, we discuss each revised draft with you exploring management alternatives, answering questions, addressing particular problems and settling on revised language. Once the documents are near completion, we recommend sending a draft to all homeowners for their review and comment. This gives owners an opportunity to participate in the revision process and usually enhances the chance of approval.

Additional Services Included

To help you carry out this part of the process, we provide a letter setting forth the procedure for homeowners to communicate their input. Constructive suggestions may be incorporated into the final version at the board’s discretion. The documents are then finalized and distributed to the owners for a vote. We provide a sample secret ballot for homeowner approval and step-by-step instructions for obtaining the percentage vote required for amendment.

Recording the CC&Rs

After you have obtained homeowner approval, we provide instructions for recording your new documents in the office of the county recorder.  We will personally record the new documents in the SF Bay Area for an additional fee.   The recorded documents become effective as soon as a signed copy is distributed to the membership.

To put The Rewrite Program™ to work for your association, and start simplifying your life, send a copy of your CC&R's, bylaws and articles of incorporation, if you have them, to Bickel & Associates, c/o Joan Anspach, 2200 Powell Street, Suite 990, Emeryville, CA 94608 (510-595-8200) for a free no-risk proposal.
